General provisions

(1) Uni-System Bau Kft., as the Data Controller, in connection with the services provided by the www.unisystembau.hu website operated by (hereinafter: the “website”), the user acts in accordance with these Data Management Regulations and information during all data management of any natural person. By accessing the website and using the website, the User accepts the provisions of these Privacy Policy as binding on him/her.

(2) The purpose of the data privacy notice is to define the scope of personal data managed by the Data Controller, the method of data processing, and to ensure the enforcement of the constitutional principles of data protection and data security requirements, and to prevent unauthorized access, alteration and unauthorized disclosure, or use, in order to ensure respect of the privacy of user as a natural person.

  1. For the purpose set in paragraph 2, controller shall treat the user's personal data confidentially, in accordance with the legal provisions in force, ensures their security, takes the technical and organizational measures and establishes the procedural rules necessary to enforce the relevant legal provisions and other recommendations.

 

Legal background

The Data Controller is obliged to comply with the legal regulations related to the processing of personal data in all phases of data processing. The processing of data by a data controller is primarily governed by the provisions laid down in the following legal acts:

  • Act V of 2013 on the Civil Code § 2:43 (e)
  • Act CXII of 2011 on the right to information self-determination and freedom of information (Data Protection Law);
  • Act CVIII of 2001 on certain issues of electronic commerce services and information society services (Eker. Act);
  • Act XLVIII of 2008 on the basic conditions and certain restrictions of economic advertising activity law (Grt.Act.)
  • Act VI of 1998 the Convention promulgated in Strasbourg 28 January 1981 on the Protection of Individuals with regard to Automatic Processing of Personal Data.
  • Act CXIX of 1995 on the management of name and address data for the purpose of research and direct business acquisition (Katv.).

 

Concepts

(1) data subject: any natural person identified or identifiable, directly or indirectly, on the basis of personal data;

(2) ’personal data’ shall mean data relating to a data subject, in particular his or her name, identifying mark and knowledge of one or more physical, physiological, mental, economic, cultural or social identities, and any inferences that may be drawn from the data subject;

(3) 'consent' means the voluntary and explicit expression of a data subject's wish, based on appropriate information, giving his or her unambiguous consent to the processing of personal data concerning him or her, in full or in part;

(4) protest: a statement by the data subject objecting to the processing of his or her personal data and requesting the termination of the processing or the deletion of the processed data

(5) ’management’ means any operation or set of operations on personal data, regardless of the procedure used, such as collection, recording, systematisation, storage, modification, use, transmission, disclosure, coordination or interconnection, blocking, erasure and destruction. In order to prevent further use of the data, taking photographs, sound or any other images, to record physical characteristics capable of identifying the person (e.g. fingerprints, palmprints, DNA samples or irises).

(6) ’data processing’ means the performance of technical tasks related to data management operations, regardless of the method and means used to perform the operations and the place of application, provided that the technical task is performed on the data.

(7) ’data transfer’ means making the data available to a specified or any third party.

(8) disclosure: making data available to anyone.

(9) ’controller’ means the natural or legal person, or any entity without legal personality, who, alone or in association with others, determines the purposes for which personal data are processed, and takes decisions on data processing (including the means used); with a data processor entrusted by him.

(10) ’processor’ means any natural or legal person, or any entity without legal personality, who carries out the processing of data under a contract, including a contract concluded in accordance with the law.

(11) ’data erasure’ means the making data unrecognizable in such a way that it is no longer possible to be recovered.

(12) ’data file’: set of data managed in or under one register.

(13) ’third party’ means any natural or legal person, or any entity without legal personality, other than the data subject, the controller or the processor.

 

Legal basis for data management

The Data Controller manages the data of the Data Subjects in accordance with the applicable data protection legislation, on the basis of their consent and in accordance with certain issues of electronic commerce services and information society services on the basic conditions of Section 13/A of Act CVIII. 2001 and certain restrictions of commercial advertising activities shall be treated in accordance with Section 6 of Act XLVIII  2008.

 

Scope of data processed, purpose and duration of data processing

This Privacy Policy covers the processing of personal data only, given that personal data can only be interpreted in relation to natural persons.

The Data Controller may process personal data related to the Data Subject for any purpose other than those specified below - in particular to increase the efficiency of its service or for market research - only with the prior definition of the purpose of data processing and with the consent of the Data Subject. This data may not be linked to the data subject's identification data and may not be passed on to third parties without their consent. The Data Controller is obliged to delete this data if the purpose of data processing has ceased or the Data Subject so provides.

The Data Controller ensures that the User can find out which data management purposes the Data Controller handles before using the service and at any time during the use, including the handling of data that cannot be directly contacted by the User. The legal basis of the data processing performed by the Data Controller is in all cases the consent of the Data Subject.

The purpose of data management is to provide personalized service to Stakeholders. Data manager for incoming emails, messages, phone, Facebook, etc. will delete the data provided together with the name and e-mail address of the interested party and other personal data voluntarily provided, no later than 5 years after the communication.

Section 5 (1), Article 6 (1) (a) and Section CVIII of 2001 on certain issues of Electronic Commerce Services and Information Society Services Act 13/A.§. (3).

 

Duration of data management

Data processed on the basis of the data subject's consent may be processed until the consent is modified or revoked. Upon expiration of the data management period, the Data Controller is obliged to delete the personal data of the Data Subject.

In order to fulfill the accounting obligations, the Data Controller shall provide the data related to invoicing for 8 (eight) years in accordance with Section 169 of Act C of 2000, and in accordance with Section XCII of 2003 on the Taxation Procedure. It is managed until the statutory limitation period.

 

Rights of Stakeholders

(1) The Data Subject may apply to the Data Controller

  1. a) information on the processing of your personal data,

(b) the rectification of his personal data; and

(c) the erasure or blocking of your personal data, with the exception of mandatory data processing.

(2) Personal data shall be deleted if

(a) its handling is unlawful;

  1. b) the Data Subject requests (except for mandatory data processing);

(c) is incomplete or incorrect and this condition cannot be legally remedied, provided that cancellation is not precluded by law;

  1. d) the purpose of the data processing has ceased or the term for the storage of the data specified by law has expired;

(e) it has been ordered by a court or the Authority.

 

Remedies

In the event of a Infringement, the Affected Party may seek legal remedy:
